TERMS OF USE – PRINTDASH

By accessing or using the Website, you (“you,” the “User”) agree to be bound by these Terms of Use and any policies referenced here (including our Privacy Policy, and Acceptable Use/Prohibited Content policy). If you do not agree, do not use the Website.

Eligibility & Acceptance

• You represent that you are at least 18 years old (or the age of majority where you live) and legally able to enter into a binding contract.
• Creating an account, placing an order, or otherwise using the Website constitutes your acceptance of these Terms.
• Certain activities (printing, fulfillment, payment, shipping) are also governed by our separate Terms & Conditions of Service. If there is a conflict, those service terms will control for orders and production.

Website & Services Overview

The Website provides information about print-on-demand (POD) products and services, tools to upload designs, place orders, pay for services, and connect to third-party platforms (e.g., Shopify/Etsy/Amazon). Some features may be beta and may change or be discontinued at any time.

Accounts

You are responsible for safeguarding your credentials and for all activity under your account. You must provide accurate, current and complete information and may not impersonate any person or entity. We may suspend or terminate accounts for suspected violations, fraud, or security risk.

Website Intellectual Property

All Website content (code, layouts, text, images, graphics, logos, trademarks) is owned by PrintDash or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable license to access and use the Website for lawful business purposes. Any unauthorized copying, modification, distribution, or reverse engineering is prohibited.

User Content & Designs

• By uploading designs or other content (“Designs”), you represent and warrant that you own or hold valid licenses to all necessary rights and that your Designs do not infringe third-party rights.
• You grant PrintDash a non-exclusive, royalty-free, worldwide license to use, reproduce, adapt (technical modifications only), and process the Designs solely to provide the Services (printing, packing, shipping, support, quality control, backups).
• Optional portfolio use: if you opt in, you grant PrintDash permission to display photos of produced items for demo/portfolio/marketing purposes. You may revoke this permission at any time by emailing us; revocation does not affect prior lawful uses.

Acceptable Use / Prohibited Content

You must not use the Website to upload, order, share, or promote content that:

• Is illegal, infringes copyright/trademark/privacy/publicity rights, or discloses third-party confidential data;
• Depicts child sexual abuse, exploitation, or promotes violence;
• Incites hatred, discrimination, or terrorism;
• Encourages self-harm, abuse of drugs, or dangerous activities;
• Involves impersonation, fraud, spam, malware, or security interference;
• Uses others’ logos, brands, or likenesses without permission. We may reject orders, remove content, suspend accounts, and/or notify authorities where appropriate.

Orders & Technical Variances (Summary)

Orders placed through the Website are additionally governed by our Terms & Conditions of Service. Due to the nature of POD, color/placement/size variances may occur within industry tolerances and screens may differ from printed output. Claim windows and error-handling procedures are defined in the service terms.

Payments, Shipping & Risk of Loss

Payment, taxes, shipping, refunds/returns, and related matters are governed by the Terms & Conditions of Service and/or the applicable carrier’s contract of carriage. Generally, risk of loss transfers upon carrier pickup at a PrintDash facility.

Privacy & Cookies

Data collection and use are described in our Privacy Policy. The Website may use cookies and similar technologies for functionality, analytics, and personalization.

Third-Party Links & Integrations

The Website may link to or integrate with third-party platforms (Shopify, Etsy, Amazon, Stripe, PayPal, shipping carriers, etc.). We are not responsible for those sites or services; your use is subject to their own terms and policies.

Disclaimers

The Website and all content/features are provided “as is” and “as available.” To the maximum extent permitted by law, PrintDash disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted/secure operation.

Limitation of Liability

To the fullest extent permitted by law, PrintDash will not be liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, business interruption) arising from or related to your use of the Website. In any case, PrintDash’s aggregate liability for Website-related claims will not exceed the amount you paid (if any) to use the Website in the 12 months prior to the event giving rise to the claim (typically $0 for browsing).

Indemnification

You agree to indemnify, defend, and hold harmless PrintDash and its officers, directors, employees, and agents from any claims, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Website; (b) your Designs or other content; or (c) your violation of these Terms or of third-party rights.

DMCA / Copyright Complaints

If you believe material on the Website infringes your copyright, send a DMCA notice to [dmca@printdash.us] including: (i) description of the copyrighted work; (ii) URL of the allegedly infringing material; (iii) your contact info; (iv) a good-faith statement; and (v) your physical or electronic signature or that of your authorized agent.

Suspension & Termination

We may suspend or terminate your access to the Website (in whole or part) at any time if we reasonably believe you violated these Terms or pose a security/fraud risk. We may also remove any content we deem inappropriate or unlawful.

Governing Law & Dispute Resolution

• Governing law. These Terms are governed by the laws of the State of [Texas], USA, without regard to conflict-of-law rules.
• Venue. The state and federal courts located in [Collin County, Texas] shall have exclusive jurisdiction, and you consent to personal jurisdiction there.
• International customers (non-US businesses). After good-faith negotiation, unresolved disputes will be settled by binding arbitration under the International Arbitration Rules of the American Arbitration Association (AAA) before a single arbitrator; hearing in English; may be conducted remotely; award may be filed for judgment in any US federal court with jurisdiction.

Changes to These Terms

We may update these Terms from time to time. The effective date appears at the top. Your continued use of the Website after an update constitutes acceptance of the revised Terms.

Severability

If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement & No Waiver

These Terms constitute the entire agreement between you and PrintDash regarding Website use. Any failure to enforce a provision is not a waiver of that or any other provision.
